Terms & Conditions

These General Terms and Conditions (“Terms”) govern the real estate brokerage services provided by Muster Immobilien GmbH (“we”, “our”, “us”) to clients and leads (“you”) for the purpose of facilitating property transactions in Germany. These Terms apply to all contracts, offers, and services unless explicitly modified in writing.
1. Scope of Services
1.1 We provide real estate brokerage services exclusively, including:

Marketing and presenting properties offered by property developers (Bauträger)

Facilitating property viewings and consultations

Assisting with negotiations between clients and developers

Coordinating and supporting contract conclusion with developers
1.2 Any services outside of this scope (e.g., financing, notary services, home staging, property valuation) may be recommended to clients but are not provided by us and do not create any contractual obligation.
2. Brokerage Agreement and Contract Formation
2.1 A brokerage agreement must be signed by the client/lead at the beginning of engagement.
2.2 The agreement specifies that in the event of a successful property transaction, we are entitled to a brokerage fee (commission) of X%, as agreed with the developer.
2.3 The brokerage fee is payable by the developer, not the client, and individual percentages and conditions are explicitly governed by the developers’ purchase contracts.
2.4 A contract with us is formed upon signing the brokerage agreement. Verbal agreements are not binding unless confirmed in writing.
3. Client Obligations
3.1 Clients agree to provide accurate and complete information regarding identity, property preferences, and financial eligibility.
3.2 Clients must promptly notify us of any changes affecting property interest or eligibility for a transaction.
3.3 Clients may not circumvent our services to conclude transactions directly with developers introduced by us; doing so may result in claims for the agreed commission.
4. Fees and Payment
4.1 The brokerage fee is agreed individually with each developer and is payable only upon successful completion of a transaction.
4.2 No additional fees are charged to the client unless otherwise explicitly agreed in writing.
4.3 Late payments by the developer do not affect our rights; we are entitled to pursue payment in accordance with the signed developer agreements.
5. Exclusivity and Non-Circumvention
5.1 Where a brokerage agreement is exclusive, the client agrees not to engage other agents or attempt to circumvent our services for the duration of exclusivity.
5.2 Any attempt to bypass our brokerage services may result in legal action to claim the agreed commission.
6. Liability
6.1 We are liable only for intentional acts or gross negligence.
6.2 Liability for minor negligence is excluded, except in cases of injury to life, body, or health.
6.3 We are not liable for inaccurate information provided by property developers or third-party service providers recommended to clients.
6.4 All advice and information provided are based on information available at the time and do not constitute a guarantee of outcomes.
7. Data Protection
7.1 By using our services, you consent to the collection, processing, and storage of your personal data in accordance with our Privacy Policy.
7.2 Collected data may include names, contact information, property preferences, and contractual information.
7.3 Data may be shared with developers, partner service providers, and regulatory authorities as required by law.
7.4 Data may be processed outside the EU/EEA, with appropriate safeguards to comply with GDPR.
8. Termination
8.1 Either party may terminate the brokerage agreement in writing, subject to accrued rights.
8.2 Termination does not affect the entitlement to fees for transactions initiated before termination.
8.3 Exclusive brokerage agreements may not be terminated early without written consent.
9. Property Information and Marketing
9.1 We strive to ensure all property information provided is accurate and complete.
9.2 Minor discrepancies, errors, or changes in property information do not constitute grounds for liability.
9.3 Photographs, floor plans, and descriptions are protected by copyright; unauthorized use is prohibited.
10. Governing Law and Jurisdiction
10.1 These Terms are governed by German law.
10.2 The place of jurisdiction for any disputes arising from these Terms is Haren, Germany.
11. Miscellaneous
11.1 If any provision is deemed invalid or unenforceable, the remaining provisions remain effective.
11.2 Changes or additions to these Terms must be made in writing and signed by both parties.
11.3 Headings are for convenience only and do not affect interpretation.
12. Acknowledgment
By signing the brokerage agreement or using our services, you acknowledge that you have read, understood, and accepted these Terms in full.
